This Privacy Statement explains how OpenDhi and its subsidiaries and affiliates collect, use, store, and disclose Personal Data from individuals who interact with us ("you"). These interactions include when you use our websites; when you request us to provide a proposal or to connect with you; when you contact us; when you register or attend any OpenDhi event, webinar, trade show, sales, or marketing activities; download an eBook, report, or other digital materials; apply for a job or reply to an OpenDhi survey.

1. Information We Collect

In the course of using OpenDhi websites, you may provide us with personally identifiable information. This refers to information about you that can be used to contact or identify you, and information about your use of the Services that may be connected with you ("Personal Information" or "Personal Data").

We may ask you to provide Personal Information when you:

  1. Use our website or applications
  2. Request quotes, services, support, whitepapers, or information
  3. Request services or register for events or webinars
  4. Create and manage an account
  5. Participate in surveys or other promotional activities online or in any other venue
  6. Provide a testimonial
  7. Interact with us on third-party social networks (subject to that third party's terms of use and privacy policies)
  8. Use the OpenDhi platform as an employee, a contractor, an external employee, or a partner

Platform Privacy Notices will be presented to users when they access and use one of the OpenDhi platforms or services in the various regions that we operate in.

Categories of Personal Information we collect may include your full name, email address, contact telephone numbers, and other information necessary to provide additional information or services. It may also include work information such as job title and other business or company information, including, but not limited to, state and country of company residence, occupation, industry, and/or any other information needed to respond to your request.

2. Legal Basis for Data Collection and Processing

Our collection and processing of your information as described above is permitted by applicable data protection law because it is:

  1. Necessary for our legitimate interests in pursuing the purposes set out above, where such interests are not overridden by your privacy interests
  2. Necessary for the performance of a contract
  3. In some cases, necessary to meet our legal or regulatory responsibilities, such as disclosures to authorities, regulators, or government bodies
  4. Processed with your consent, which we obtain from you from time to time — such as when you opt in to receive marketing communications, via email or other communication means

3. How We Use Your Personal Information

Your personal information will be collected and handled by us for the following purposes:

  1. To respond to your walkthrough, demo, or information request
  2. To best tailor content and resources according to your interests
  3. To respond to your questions when you contact us
  4. With your consent, to send you direct marketing about OpenDhi (and, where relevant, OpenDhi Group platforms) that might interest you, by email, telephone, or other communication methods
  5. To help us create, publish, and improve content most relevant to you
  6. To ensure content on the website is presented effectively for you and your device
  7. To further develop and improve the website and our systems
  8. To perform analytical research on our prospective customer base, including the platforms and use cases they're interested in
  9. To transfer data to third parties where necessary (see below)
  10. Where necessary, to comply with any legal obligation
  11. To investigate or respond to incidents and complaints, and to cooperate with investigations carried out by regulators or authorities where required

4. Do You Have to Give Us Your Information?

You are not obligated to provide personal information when generally browsing our website. However, we cannot fulfil a walkthrough, demo, or other specific request unless you do so.

5. How Long We Keep Your Information

We will keep your information for as long as you wish to receive our communications and we have an active business relationship with you. Typically, we delete data we are not required to retain for contractual or statutory reasons 12 months after our last contact with you.

6. Sharing with Third Parties

We disclose your information to third parties only in the following circumstances:

  1. To suppliers, contractors, and agents: we may engage other companies to perform functions on our behalf, such as hosting or maintaining website content, or providing marketing services. These recipients only access your personal information as needed to perform their functions, are not permitted to use it for any other purpose, and are subject to contractual confidentiality obligations.

7. Sub-Processors and Service Providers

OpenDhi engages trusted third-party service providers ("Sub-Processors") to support website operations, customer communications, analytics, security, and business administration. These providers process personal data only on our behalf and only for purposes we specify. All Sub-Processors are subject to appropriate contractual and data protection obligations, including confidentiality and security requirements.

8. IP Addresses and Cookies

We collect information about your computer, including (where available) your IP address, operating system, and browser type, for system administration. This is statistical data about browsing actions and patterns, and we will not use it in isolation to identify you or any individual. If you provide us with personal data, such as your name, we may match your IP address and browsing history with that personal data.

We will only place strictly necessary and session cookies on your computer when you visit our website. To provide a more complete experience, we may ask for your consent to place additional cookies, such as analytics or certain third-party cookies, to improve website performance. 9. Where Your Information Is Stored and Processed

As explained above, we share your personal information with:

  1. Third-party suppliers, contractors, or agents: where we use a third-party supplier, contractor, or agent, your personal information remains under our control, and we have controls in place to ensure your personal information is adequately protected.
  2. Other companies within OpenDhi: we have entered into a groupwide Master Data Transfer Agreement arrangement to ensure your personal information continues to be subject to an adequate level of protection.

10. International Data Transfers

OpenDhi operates globally, with teams and infrastructure across multiple regions, including the Netherlands, the United Kingdom, and India. Your personal information may be transferred to and processed in countries outside the one in which you are located, including countries whose data protection laws may differ from those of your home jurisdiction.

Where we transfer personal data internationally, we do so on the basis of an applicable adequacy decision, or by putting in place appropriate safeguards — such as Standard Contractual Clauses or equivalent mechanisms — to protect your information, in accordance with applicable data protection law.

11. Your Data Access Rights

Under applicable data protection laws, you may have the following rights:

  1. Right to access and obtain a copy of your personal information
  2. Right to correct your personal information, if you can demonstrate it is inaccurate
  3. Right to object to processing and/or automated decision-making
  4. Right to data portability
  5. Right to be forgotten / have your data deleted, subject to any legal rights or obligations we may have to retain it

To the extent our processing is based on your consent, you also have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing carried out before you withdrew it.

12. Marketing Communications

We will only send marketing communications to you via email or other means where you have consented to this.

We will offer a checkbox on the forms we use to collect your personal information, which you must actively select to agree to receive marketing communications. Where we send marketing communications by email, you may opt out at any time by clicking 'unsubscribe' in the email, or by contacting us at marketing@opendhi.com with your name, email address, phone number, and the communications you'd like to stop receiving.

13. Changes to This Notice

The terms of this notice may change from time to time. We will publish any material changes through appropriate notices on this website or by contacting you through other communication channels.
